A service mark is a word, symbol, device, or any combination thereof, which is used to distinguish the services of one person from the services of another person, and to indicate the source of the services. A McDonald's® is not a Burger King®. To be federally registrable, the trademark or service mark cannot be generic or the common descriptive name of the product or service that it is to identify and must be used in interstate commerce (across state lines).
